The writ petition was filed for seeking the direction which will be given upon the respondents not to lease out “Bhairab River” which is using from time immemorial by thousands of Public at large residing both sides of the bank of bhairab River as government Khas land marked Yellow in the sketch map situated in Mouza No. 228 Kaikhali, C.S and S.A Khatian No. 1, C.S Plot No. 525/972, 01, 768, 961/974, 826/973 Bhairab Nadi of land measuring 128 acres, which will be against the public policy and public interest and will create environment pollution, also seriously detrimental and prejudicial to the interest of the public at large of the said area.

Rule Nisi isued calling upon the respondents to show cause as to why a direction shall not be issued upon respondents not to lease out the ” Bhairab River” which is used by the public as khas land from time immemorial situated in Mouza 228 Kaikhali, C.S and S.A Khatian No. 1, C.S Plot No. 525/972, 01, 768, 961/974, 826/973 Bhairab Nadi of land measuring 128 acres, which will be against the public policy and public interest and will create environment pollution, also seriously detrimental and prejudicial to the interest of the public at large of the said area .
Pending hearing of the Rule, the parties are directed to maintain status quo in respect of possession and position of the disputed Jalmohal for a period of 03 (three) months from date.
