Facts

Khulna City is facing threats emerging from unplanned and unauthorised construction that adversely affected the comfort and well-being of city dwellers.  Khulna UnnayanKartipakkha prepared to build a commercial complex at the Car Park area of Nirala Residential Area, which was proposed in the original Master Plan.

The High Court issued a Rule Nisi upon the respondents to show cause as to why the impugned proposed construction of ‘KDA Commercial Complex Building’ in the Car Park which was approved in the Master Plan and lay out Plan of KDA should not be declared to have undertaken without lawful authority and of no legal effect, and why the respondents should not be directed to construct the Car Park in the said Plot as prescribed in the Master Plan.
