On 26.12.2012 in a national newspaper namely ‘The Daily Star’, an appointment notice by the Registrar of Moulana Bhasani Science & Technology University was published and clause ‘Kha’ of that notice was against the spirit of the Education Policy, and public interest and violative of the fundamental rights of the petitioner, as it was clearly mentioned that the applicants must hold a Masters with Honors Degree from any Public University only. The petitioner had obtained LLB & LLM degrees from a private University namely Atish Dipankar University of Science & Technology.

The High Court issued a Rule Nisi upon the respondents to show cause as to why Clause ‘Kha’ in the Appointment Notice by the Registrar of MoulanaBhashani Science and Technology University, inviting applications for appointment as Lecturer, for only those who have Masters with Honours degree in the relevant subject from the public University should not be declared to have been made without lawful authority and is of no legal effect.
