The failure of the Respondent to comply with their constitutional and statutory duties to secure the right to life of persons across the country by taking appropriate measure and to undertake regular monitoring of safety conditions on the roads and highways to prevent road accidents.

The Court passed an order of injunction on 25.08.2011 which was extended till 29.11.2011, restraining the licensing authority from issuing or renewing any driving license with the due process of law.

The Court issued a Rule Nisi on 17.10.2011 upon the respondents to show cause as to why the failure to comply with their statutory and constitutional duties to take effective measures in development, improvement and maintenance of the national highways should be declared to be violative of the fundamental Constitutional rights.
