Facts

The Honorable Prime Minister took pledges on 19 October 2009, as such the Respondent of this instant petition are accountable to ensure the implementation of  the Statutory object of the Bangladesh Persons with Disability Welfare Act 2001, and in the light of the recent direction as given by the Hon’ble Prime Minister on 19 October, 2009 in the 5th“National Conference for Disabled persons” to improve and bring about the rights of PWDs in light of the Convention on the Elimination of Discrimination against Women (CEDAW) and United Nation Convention on Rights for person with Disability (UNCRPD) for the  persons with and for the disabilities faced by the person especially Women with Disability in their day to day life.

The Court issued a Rule Nisi calling upon the respondents to show cause as to why the respondents should not be directed to take immediate measures to implement the statutory object ensured in the Bangladesh Persons with Disability Welfare Act 2001 and in light of the recent directions given by the Prime Minister on 19.10.2009 in the 5th National Conference for disabled persons, and on the basis of CEDAW and UNCRPD ratified by Bangladesh.The Court directed the respondents to report to Court every six months on the adoption and implementation of the Prime Minister’s directives given by her speech and to make immediate circular to create accessibility for disabled persons by building ramps and toilets in all public places including Government and private corporations and office.
