The petitioners challenged the threatening to evict the petitioners from their homesteads, harassing, intimidating on the plea of unauthorized occupation of the Gudaraghat Basti, CS DAG No. 776 & 777, Mouza- Zoarshahara, JL No. 271, Khatian No. 127, Poschim (West) Vnashatek/Gudaraghat Section 15, Ward (old) No. 4 (new 95) PS. Kafrul, district-Dhaka, without any notice and without due process of law.

The court issued a rule and directd the respondents to restrain from interfering in any manner with the peaceful possession of the slum dwellers homestead at Gudaraghat/Vashantek Basti, CS Daag No. 776 & 777; Mouza- Zoa Shahara; JL No. 271; Khotian No. 127, Poschim (West) Vashantek/ Gudaraghat; Section No, 15; Ward (Old) No.  4 (New 95); PS- Kafrul; district- Dhaka in any way up to 22.10.05.

The court disposed the Rule with the observation that the slum dwellers of “Gudaraghat Basti ” situated on C.S. Plot nos. 776 and 777 under Mouja: Zoarshahara, measuring an area 1.65 acres of  land shall not be evicted without their rehabilitation according to the programmes of the Government within two years from date and within this period the Government shall take appropriate step for their rehabilitation.
