Facts

On 8/7/2003 the launch named M.V. Nasrin had sunk down in the Meghna-Dakatia river along with approximately 700 passengers by the attack of tornado. After this accident approximately 230 people were able to reach the safe zone, 110 peoples were died and 199 peoples were still now missing. Only compensation for this type of accident is not enough remedy for the aggrieved persons rather it need to ensure the implementation of the adequate punishment upon those responsible authorities whose lack of awareness and pre preparation to tackle this kind of natural calamities is actually responsible for this type of accident. By realizing this perspective on 5/7/2004 the 121 passengers who were luckily alived from this accident filed Money Suit No. 27 of 2004 in the Joint District Judge 3rd court, Dhaka by taking the assistance of BLAST against the responsible authorities for demanding 28,93,94,000/= as compensation. Afterwards the suit was delivered to Joint District Judge 7th Court, Dhaka for disposal and the new number was given which was 344 of 2008.

The learned Joint District Judge 7th Court, Dhaka   rejected the Miscellaneous Case no. 02 of 2016 according to Order 9 Rule 13A of the Code of Civil Procedure 1908 and affirming the exparte Judgment and partly Decree delivered on 02.02.2016 by the Joint District Judge 7th Court, Dhaka in the Money Suit  No. 344 of 2008.

After being heard both parties submission in regarding Civil Revision No. 3537 of 2016 the Hon’ble High Court Division issued the rule and delivered the stay order upon the implementation of the exparte Judgment and partly Decree delivered on 02/02/2016 by the learned Joint District Judge 7th Court, Dhaka in the Money Suit No. 344/2008.
