BLAST, Ain o Salish Kendra (ASK) and Shammilita Samajik Andolon filed a writ petition challenging incidents of unauthorized, illegal and forcible entry, search and seizure and unlawful arrest by the Bangladesh Rifles (BDR) personnel in Dhaka and Narayanganj. The BDR under its statutory framework is entrusted with security of the border areas, but in the name of ‘operations’ they were arresting and subjecting people to cruel and inhuman torture in the capital and Narayanganj, both areas situated far away from the border.

The Court issued a Rule Nisi directing the respondents to show cause as to why the illegal arrest, detention, forcible entry, search and seizures in the name of ‘operation’ should not be declared to be illegal . It also issued a direction upon the respondents not to arrest or harass in the name of the ‘operation’.

Details
The Rule was discharged for default as no one appeared on behalf of the petitioners when the matter was taken up for hearing on 04.07.2010 and 05.07.2010. The Court had earlier directed the respondents not to arrest or harass the persons named in the application without due process of law.
