Facts

The blooming of tannery industries threatened the environment and is backed by scientific research and investigations from both national and international level. Despite the impugned government notification, there was no implementation and now the number of industries has grown. As a result of such deadly practices, ecology and bio-diversity were rapidly consumed by the toxic environment pollution.

Details

The High Court directed the respondents to control the pollution from industrial units, classified as “Red” within 1 year from the date of the receipt of the judgment and order and report compliance to the court within 6 weeks. Units classified under the category “Orange Ka” and “Orange Kha” must adopt similar measures within 2 years from the date of the receipt, and directed the Director General, Department of Environment to ensure the compliance.
The Court directed the Secretary, Ministry of Industries (Respondent No. 1) to ensure that no new industry/factory was set up without proper measures to control pollution as required under ECA 1995 and ECR 1997.
