A survey was conducted by BLAST which revealed the real scenario of Persons With Disabilities (PWD) and how discrimination against them acts as a barrier to work, employment, wages, education and dignity. A Writ Petition was filed by BLAST and others in the matter of inaction and failure to take action on the part of the Respondents, to publish a gazette notification as required under section-1(2) (b) of the “Rights and Protection of the Persons with Disabilities Act 2013” in order to bring into force or activate the Sections 31 and 36, after forming necessary committees as required under Sections 17, 19, 21, 23 and 24 of the said Act and also framing of Rules under section 41 of the said Act.
A Rule Nisi was issued calling upon the respondents to show cause as to why an order should be made directing the respondents to publish a gazette notification activating sections31 and 36 after forming necessary committees as required under sections 17, 19, 21, 23, and 24 of the Rights and Protection of Persons with Disabilities Act, 2013 and why a further direction should not be made upon them to frame Rules under section 41 of the said Act.
